बिलासपुर।छत्तीसगढ़ हाईकोर्ट ने रोजगार एवं प्रशिक्षण विभाग में नियुक्त 723 प्रशिक्षण अधिकारियों में से 50 अफसरों को बर्खास्त करने के नोटिस को निरस्त कर दिया है। हाईकोर्ट के इस आदेश से अफसरों को राहत मिली है। वहीं शासन को झटका लगा है। मामले की सुनवाई जस्टिस संजय के अग्रवाल की सिंगल बेंच ने की है।
सुनील कुमार गढ़ेवाल, चंद्रप्रकाश कश्यप, टिकेंद्र वर्मा, इंद्रा नायक के साथ ही सौरभ साहू ने हाईकोर्ट में अलग-अलग 32 याचिकाएं दायर की थी। इसमें बताया गया कि राज्य शासन ने रोजगार एवं प्रशिक्षण विभाग में 723 प्रशिक्षण अधिकारियों की नियुक्ति के लिए 30 सितंबर 2010 को विज्ञापन जारी किया था। इसके बाद 10 जनवरी 2013 को सभी चयनित उम्मीदवार को नियुक्ति के आदेश जारी किया गया। 2015 में उनकी प्रशिक्षण अवधि समाप्त हो गई। इसके बाद 2020 में नियमितीकरण का आदेश जारी किया, जो 2015 से लागू हो गया।

याचिका में बताया गया है कि नियमितीकरण करने के बाद 50 प्रशिक्षण अधिकारियों को 6 अक्टूबर 2021 को शासन ने एक कारण बताओ नोटिस जारी किया। इसमें कहा गया कि नियुक्ति के समय रिजर्वेशन रोस्टर का पालन नहीं किया गया था, इसलिए क्यों न उनकी नियुक्ति को शून्य घोषित कर दिया जाए। याचिका में इस नोटिस को चुनौती दी गई थी।
सुनवाई के दौरान सुप्रीम कोर्ट के आदेशों का हवाला दिया गया। साथ ही यह भी बताया कि उनको दी गई नियुक्ति में रिजर्वेशन रोस्टर का पालन करने की जानकारी दी गई है। कोर्ट में शासन की तरफ से अधिवक्ता ने बताया कि भर्ती समिति में शामिल अधिकारियों के खिलाफ जांच चल रही है। उनके खिलाफ फैसला लिया जाना है।

हाईकोर्ट ने सुनवाई के दौरान प्रस्तुत सुप्रीम कोर्ट के निर्णय को आधार मानते हुए सहमति जताई है। साथ ही पूर्व में जारी नोटिस को खारिज कर दिया है। हाईकोर्ट ने शासन को यह छूट भी दिया है कि कानून के दायरे में रहकर कार्रवाई की जा सकती है, लेकिन इसके लिए प्रक्रिया का पालन करना आवश्यक होगा। प्रकरण में याचिकाकर्ताओं की तरफ से अधिवक्ता फैजल अख्तर, आशीष कुमार चंद्राकर व उत्तम पांडेय ने पैरवी की।

Bilaspur:- The Chhattisgarh High Court has quashed the notice of dismissal of 50 officers out of 723 training officers appointed in the Employment and Training Department. The officers got relief from this order of the High Court. And the government has got a setback. The matter was heard by a single bench of Justice Sanjay K Agarwal.
Sunil Kumar Gadhewal, Chandraprakash Kashyap, Tikendra Verma, Indra Nayak as well as Saurabh Sahu had filed 32 separate petitions in the High Court. It was informed that the State Government had issued an advertisement on 30 September 2010 for the appointment of 723 training officers in the Employment and Training Department. After this, on 10 January 2013, the order of appointment was issued to all the selected candidates. His training period ended in 2015. After this, a regularization order was issued in 2020, which came into effect from 2015.

It has been told in the petition that after regularization, the government issued a show cause notice to 50 training officers on 6 October 2021. It said that the reservation roster was not followed at the time of appointment, so why not declare his appointment as void. This notice was challenged in the petition.
The orders of the Supreme Court were cited during the hearing. Along with this, it was also told that in the appointment given to them, information has been given to follow the reservation roster. On behalf of the government in the court, the advocate told that investigation is going on against the officers involved in the recruitment committee. A decision has to be taken against them.

The High Court has agreed on the basis of the decision of the Supreme Court presented during the hearing. Also, the notice issued earlier has been quashed. The High Court has also given the exemption to the government that action can be taken within the ambit of law, but for this it will be necessary to follow the procedure.Advocates Faizal Akhtar, Ashish Kumar Chandrakar and Uttam Pandey appeared on behalf of the petitioners in the case.
